Terms of Service
Effective October 29, 2026.
Please read these terms before using the Pond Builders Las Vegas website or sending us a request. They explain how the website works and how website requests relate to paid work.
Privacy Policy1. Who we are and what these terms cover
In these terms, Pond Builders Las Vegas, PBLV, we, us, and our mean the business operating this website under the name Pond Builders Las Vegas. You means the person using the website or sending a request.
These terms cover use of our website, its content, and its inquiry tools. They also explain the steps that come before a service or purchase agreement. They do not replace a signed project, maintenance, repair, or purchase agreement.
By using the website after being given notice of these terms, you agree to them to the extent that an agreement is formed under applicable law. If you do not agree, please stop using the website. Where the law requires a specific notice, signature, or other form of consent, we must meet that requirement.
2. Your authority to make a request
You must be at least 18 and legally able to enter a contract to request paid work or make a purchase. If you act for a property owner, business, association, or another person, you must have authority to act for them. Give us accurate contact and project details, and tell us when those details change.
3. An inquiry is not a confirmed booking
Sending a form, photo, message, or request does not by itself create a service contract, place an order, reserve fish or plants, or confirm an appointment. An automatic reply only confirms that a system received the request. It does not mean that we have reviewed or accepted it.
We must confirm availability and the agreed next step. A consultation or site visit does not, by itself, authorize additional paid work. Do not rely on an unconfirmed request for urgent help.
4. Website descriptions, prices, and availability
Website photos, project examples, and descriptions show general options. They do not promise the same result, materials, water clarity, appearance, or performance at every property. Colors and sizes may look different on a screen. Living plants, fish, stone, and other natural materials vary.
A price, estimate, or availability statement on the website is general information unless we clearly make a specific offer. A written quote will state the work or items covered, the price, any stated expiry date, and relevant conditions. Site conditions and the final scope may affect the quote.
Fish, plants, materials, and appointment times are subject to confirmation. We may correct website mistakes and update information. A correction does not give us the right to change an accepted agreement without the agreement or legal right needed to do so.
5. Your written agreement controls paid work
The scope, price, payment schedule, timing, materials, care duties, and any agreed warranty for paid work belong in the applicable written agreement. For a project that requires a signed contract, work is governed by that signed contract and its approved written changes.
If these website terms conflict with a signed service or purchase agreement, that agreement controls the paid work or purchase. Applicable law controls in all cases. These terms do not replace any required contractor disclosure, cancellation form, permit, plan, signature, or other contract document.
6. Payments, cancellations, and refunds
Any deposit, progress payment, payment deadline, cancellation charge, refund rule, or return condition must be stated in the applicable agreement and must comply with the law. These website terms do not create a deposit requirement, a nonrefundable payment, or a cancellation fee.
Contact us promptly if you need to cancel or change a confirmed appointment or order. Any right to cancel, obtain a refund, withhold a payment, dispute a charge, or use another remedy under applicable law remains in place. Required notices and cancellation rights for sales made at a home or another covered location are not waived by using this website.
7. Scheduling and delays
A date shown on the website or discussed during an inquiry is an estimate until confirmed in the applicable agreement. Weather, extreme heat, unsafe conditions, permits, access problems, supply delays, and hidden site conditions may affect timing.
If a problem affects agreed work, we will communicate the issue and any proposed change. An event outside our reasonable control does not automatically cancel our duties, permit an added charge, or remove your rights. The signed agreement and applicable law govern delays, changes, and any right to end the work.
8. Property access and safe working conditions
Before work begins, confirm that you own the property or have the owner's permission. Provide the access and available water or power agreed for the work. Tell us about known hazards, leaks, buried lines, private utilities, past repairs, fragile surfaces, chemicals, fish health concerns, and other facts that may affect the work.
Keep children, visitors, and pets clear of active work areas. Do not enter a marked work area, move barriers, or operate equipment being serviced without first checking with the crew. Tell us about access rules, gate codes, association rules, or other restrictions that apply to the property.
We may pause affected work when a condition is unsafe or when required access or information is missing. Any resulting change in scope, price, or timing must follow the agreement and the law. These duties do not transfer to you any permit, utility-location, inspection, safety, or other duty that the law places on us.
9. Existing conditions and changes to the work
A photo, phone discussion, or limited site visit may not reveal hidden damage or the full condition of a pond, pipe, liner, electrical system, soil, or structure. A quote covers the inspection and work described in it. It is not a promise that every hidden defect has been found.
If we find an issue that changes the agreed work, we will explain the issue and the proposed next step. Changes in scope or price must be agreed in writing when the agreement or law requires it. These terms do not authorize an open-ended charge or waive responsibility for damage we cause.
10. Fish, plants, and living pond systems
A pond is a living system. Fish and plants may be affected by heat, water quality, oxygen levels, disease, parasites, predators, power loss, transport, handling, and conditions that are not visible at the time of a visit. Growth, color, breeding, behavior, and long-term survival can vary.
A website image, general care article, or routine service description is not a promise that a fish, plant, or pond will remain free of every illness, loss, algae problem, or equipment failure. Any specific health, condition, or performance promise must be read with the applicable sale or service agreement and the rights provided by law.
This explanation of natural risks does not release us from responsibility for negligent care, a failure to perform agreed work, a warranty that applies, or any duty the law requires. Ask us to clarify the agreed handling, care, and monitoring duties before work or a transfer begins.
11. Care between visits and urgent problems
A scheduled maintenance visit covers the tasks and time stated in your agreement. It does not include continuous monitoring or every repair unless that service is expressly included. Follow the care instructions supplied for your system, and tell us promptly about a change or problem. Any duties that we accept in writing remain ours.
The website and its articles provide general information. They do not replace a property inspection, a system-specific service plan, or advice from a qualified veterinarian about an animal's health. Do not use the website as the sole basis for chemical dosing, electrical work, structural work, or treating a sick fish.
Website forms and email are not emergency response channels. A message does not guarantee that someone will see it immediately or that service will be available. For an immediate threat to people or property, use the appropriate emergency service. For urgent animal health concerns, contact a qualified veterinarian.
12. Product and workmanship warranties
Any express warranty for paid work or goods is governed by its actual terms and applicable law. A manufacturer's warranty may have its own conditions and claim process. It does not replace any separate responsibility that we have under our agreement or the law.
These website terms do not create a new warranty period, remove an existing warranty, or limit a remedy that cannot lawfully be limited. The website disclaimers below concern the website itself; they are not a blanket disclaimer of warranties for construction, maintenance, equipment, fish, or plants.
13. Our website content
Unless stated otherwise, the website's text, design, logos, photos, graphics, and other content belong to PBLV or are used with permission. You may view the website and save or print reasonable portions for your personal use or to consider our services.
You may not sell, republish, or use our protected content or branding to promote another business without permission. Do not remove ownership notices or suggest that we sponsor or endorse you. This section does not restrict fair use, lawful quotation, honest reviews, or other rights the law protects.
14. Photos, messages, and other material you send
Only send material that you own or have permission to share. Avoid including private information about other people unless you have a lawful reason and any permission needed to do so. Do not send passwords, full payment-card details, or other sensitive information through a general inquiry form.
You keep ownership of your material. You give us a limited, nonexclusive right to use, copy, and share it with people helping us answer your request, prepare a quote, carry out agreed work, and keep related business records, subject to our Privacy Policy and applicable law. These terms alone do not give us permission to use your name, likeness, or private project photos in advertising.
You may share honest opinions and reviews about our work. These terms do not restrict that right, impose a fee for a review, or transfer ownership of your review to us.
15. Use the website lawfully
Do not use the website to commit fraud, impersonate someone, send threats or unlawful material, spread malicious software, interfere with the site, bypass its security, or try to access information that is not yours. Do not use automated tools in a way that harms the site or defeats access controls.
You are responsible for your unlawful acts and intentional misuse to the extent provided by law. We may take reasonable steps to protect the website and its users. We do not use these rules to prevent lawful criticism or the exercise of consumer rights.
16. Privacy and contact permissions
Our Privacy Policy explains how information submitted through the website is handled. Read it before sharing personal information. These terms do not replace that policy or any consent required by privacy law.
When you ask us to contact you, we may use the contact details you provide to respond to that request and discuss the related work, subject to applicable law. A service inquiry is not, by itself, consent to unrelated marketing or to any automated call or text for which separate consent is required.
Email, internet services, and text messages can experience delays or delivery failures. If an important message has not been acknowledged, contact us through another listed method. This does not change a legally required notice process or a notice method stated in your signed agreement.
17. Links and third-party services
The website may link to other websites or include tools supplied by another provider. That provider may have its own terms and privacy practices. Review them before sharing information or making a purchase through that provider.
A link does not, by itself, mean that we endorse every statement, product, or service on the linked site. We do not control websites operated independently of us. This section does not remove responsibility for our own conduct or for duties that the law places on us when we use a service provider.
18. Website availability and information
We aim to keep the website useful and accurate, but it may contain mistakes or become unavailable. We may update, repair, suspend, or remove website features. We do not promise uninterrupted access, that every page will always be current, or that the website will meet every user's needs.
To the extent the law allows, the website and its general information are provided as is and as available, without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This disclaimer applies only to website use. It does not excuse misleading statements, remove warranties for paid goods or work, or limit any promise or right that the law protects.
19. Limits on website liability
To the extent the law allows, PBLV and the people who provide the website on our behalf are not liable for indirect, incidental, special, or consequential losses arising solely from your use of, or inability to use, the website. These are losses beyond the direct harm, such as lost business, lost profit, or a lost business opportunity. This limit applies whether a claim is based on contract or another legal theory, even if the possibility of the loss was raised beforehand.
This limit does not apply to losses from paid construction, maintenance, repair, or goods; those are governed by the applicable agreement and law. It also does not exclude or limit responsibility for our negligence, fraud, willful misconduct, breach of a duty that cannot be waived, or any other liability that the law does not allow us to limit.
Nothing in these terms takes away mandatory consumer protections, privacy rights, contractor obligations, required warranties, cancellation rights, or rights to seek a lawful remedy. If a limitation is not allowed in your circumstances, it does not apply to you.
20. Questions, disputes, and governing law
Please contact us if you believe there is a mistake, service problem, or dispute so that we can try to address it. Contacting us is voluntary and does not prevent you from contacting a regulator, seeking legal advice, using an available court, or exercising a legal right. It does not shorten or extend any legal deadline.
Nevada law and applicable federal law govern these website terms, subject to any mandatory protections that apply to you. Subject to those protections, you and we consent to the jurisdiction of courts in Clark County, Nevada for disputes about the website. This does not prevent a claim in another court when applicable law gives you that right.
21. Changes to these terms and website access
We may update these terms by posting a revised version with a new effective date. A change applies to website use after that date. It does not rewrite an existing service or purchase agreement or apply retroactively to an earlier dispute. We will provide any notice or obtain any consent the law requires.
We may restrict website access for a material breach of these terms, a security threat, or a legal requirement. Restricting access does not cancel a paid agreement, erase an accrued claim, or remove a right the law protects.
22. If part of these terms cannot be enforced
If a court finds one part of these terms invalid or unenforceable, the remaining parts will continue to apply to the extent the law permits. Our decision not to enforce a term on one occasion does not by itself waive it for every future occasion.
These terms govern website use only. No statement here gives either party authority to waive a right, remedy, duty, or liability that cannot lawfully be waived.
